Terms of Service

These Terms of Service govern your use of TheRain's ride-hailing, delivery, school transport, and fleet management services. Please read them carefully before using our platform.

1. Acceptance of Terms

By downloading, installing, or using the TheRain application or website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms constitute a legally binding agreement between you and TheRain Technologies. By accepting these terms, you confirm that you have read, understood, and agree to comply with all provisions outlined herein.

Agreement Date

Your agreement to these terms begins on the date you first use TheRain services, whether by creating an account or booking as a guest.

2. Our Services

TheRain provides the following transportation and logistics services in Cameroon:

  • Classique Ride — Affordable everyday rides across the city
  • VIP Ride — Premium vehicles with top-rated drivers
  • Delivery — Fast and secure package delivery
  • School Transport — Safe, monitored transport for children
  • Fleet Management — Enterprise solutions for businesses
  • Scheduled Rides — Advance booking up to 7 days ahead

TheRain acts as a technology platform connecting riders with independent driver partners. TheRain does not provide transportation services directly but facilitates connections between users and drivers.

3. Eligibility

To use TheRain services, you must meet the following requirements:

  • Be at least 16 years of age to use rider services
  • Be at least 21 years of age to register as a driver
  • Have a valid phone number in Cameroon (+237)
  • Provide accurate and truthful registration information
  • Have legal capacity to enter into binding agreements
  • Not be previously banned or suspended from TheRain

4. User Accounts

4.1 Account Creation

  • One account per person — duplicate accounts are strictly prohibited
  • You are responsible for maintaining the security of your account credentials
  • You must notify TheRain immediately of any unauthorized account access
  • Account credentials must not be shared with any other person

4.2 Guest Accounts

Users may book rides without creating an account as a guest. Guest users must provide their name and phone number before booking. Guest accounts have limited features — wallet, ride history, and saved locations are not available to guests.

4.3 Account Verification

TheRain uses OTP (One-Time Password) verification for account activation and sensitive actions. You agree to receive SMS messages from TheRain for verification purposes.

5. Rider Terms

5.1 Booking a Ride

  • Riders must provide accurate pickup and drop-off locations
  • Riders must be ready at the pickup location when the driver arrives
  • Riders are responsible for ensuring all passengers comply with these terms
  • Maximum passenger capacity must not be exceeded

5.3 Rider Responsibilities

  • Treat drivers with respect and professionalism
  • Do not damage or soil the vehicle
  • Wear seatbelts at all times during the ride
  • Do not distract the driver while driving
  • Report any safety concerns immediately via the SOS button or support

6. Driver Terms

6.1 Driver Registration Requirements

  • Valid National ID (not expired)
  • Valid driver's license for the vehicle category
  • Current vehicle insurance document
  • Vehicle must pass TheRain quality inspection
  • Successful AI verification and manual admin review
  • OTP activation after approval

6.2 Driver Obligations

  • Maintain a clean, roadworthy, and properly branded vehicle
  • Follow all Cameroonian traffic laws and regulations
  • Treat all riders with respect and professionalism
  • Maintain CCTV equipment in working condition at all times
  • Report accidents, incidents, or safety concerns immediately
  • Keep license, insurance, and vehicle documents current
  • Respond to AI maintenance alerts within 48 hours

7. Payments & Fees

7.1 Accepted Payment Methods

  • MTN Mobile Money (MTN MOMO)
  • Orange Money
  • Visa / Mastercard
  • Bank Transfer
  • Cash (for eligible rides)
  • TheRain Wallet

7.2 Fare Calculation

Fares are calculated based on base fare, distance traveled, and time. Pricing varies by region and ride type. All fares are displayed before booking confirmation. TheRain reserves the right to apply surge pricing during high-demand periods.

7.3 Refund Policy

Refund Process

Refund requests must be submitted within 7 days of the ride. Approved refunds are processed within 3-5 business days to the original payment method. Cash payments are refunded via TheRain Wallet.

8. Prohibited Conduct

The following activities are strictly prohibited on the TheRain platform:

  • Providing false or misleading information during registration or booking
  • Harassing, threatening, or abusing drivers, riders, or TheRain staff
  • Attempting to manipulate GPS, fares, or payment systems
  • Using TheRain for illegal activities or transporting prohibited items
  • Creating multiple accounts to bypass suspensions or restrictions
  • Sharing account credentials with unauthorized persons
  • Tampering with or disabling CCTV equipment
  • Driving under the influence of alcohol or drugs
  • Submitting fake screenshots or fraudulent payment confirmations
  • Damaging TheRain vehicles or property
Zero Tolerance Policy

TheRain has a zero-tolerance policy for violence, sexual harassment, discrimination, and fraud. Violations will result in immediate permanent account termination and may be reported to law enforcement authorities.

9. Suspension & Termination

9.1 Grounds for Suspension

  • Violation of these Terms of Service
  • Fraudulent activity detected by our AI system
  • Multiple complaints from other users
  • Trust Score falling below acceptable threshold
  • Failure to maintain required documents (drivers)

9.2 Appeals Process

Suspended users may submit an appeal through the TheRain app or by contacting support@therain.cm. Appeals are reviewed within 48-72 hours. TheRain's decision on appeals is final.

10. Limitation of Liability

TheRain provides a technology platform to connect riders and drivers. To the maximum extent permitted by applicable law:

  • TheRain is not liable for the actions or omissions of drivers or riders
  • TheRain is not responsible for delays caused by traffic, weather, or other external factors
  • TheRain's liability for any claim is limited to the fare paid for the specific ride in question
  • TheRain is not liable for indirect, incidental, or consequential damages
Insurance

All TheRain drivers are required to maintain valid vehicle insurance. TheRain strongly recommends that riders also maintain personal accident insurance for additional protection.

11. Dispute Resolution

In the event of a dispute between users or between a user and TheRain:

  • Contact TheRain support first at support@therain.cm
  • Allow 72 hours for initial response and investigation
  • Provide all relevant evidence (screenshots, receipts, etc.)
  • TheRain's decision after investigation is binding

These Terms of Service are governed by the laws of the Republic of Cameroon. Any unresolved disputes shall be subject to the jurisdiction of the competent courts of Cameroon.

12. Changes to Terms

TheRain reserves the right to modify these Terms of Service at any time. When significant changes are made, we will:

  • Send a push notification via the TheRain app
  • Send an email to your registered address
  • Display a prominent notice on our website and app
  • Update the "Last Updated" date at the top of this page

Continued use of TheRain services after changes take effect constitutes acceptance of the revised terms. If you do not agree to the new terms, you must stop using TheRain services.
